    The 3DS bill (standing for differentiation, decentralisation, deconcentration and simplification of local public action) was adopted in its final reading at the Assemblée Nationale and the Senate in France on 8-9 February. The MOT is delighted about the inclusion for the first time of a chapter devoted to cross-border cooperation in a piece of legislation.

    From 1 January until 30 June 2022, France holds the presidency of the European Union Council, for the 13th time. At a press conference on 9 December, President Emmanuel Macron set out the presidency’s three main themes: "recovery", "power" and "belonging". On this last point, he emphasised that the feeling of belonging to the European region had "declined" in France, as in other EU countries.

    Following its adoption at its first reading in the Senate on 21 July 2021, the 3DS bill (standing for “differentiation, decentralisation, deconcentration and various measures to simplify local public action”) will be examined under a fast-track procedure in the Assemblée Nationale, in France, from the beginning of December. Taking on a number of the proposals put forward by the MOT, the senators adopted a series of amendments relating to cross-border issues.

    Since 2018, the advances in Franco-German relations are major: the signing of the Aachen Treaty, the creation of the Franco-German Committee on Cross-border Cooperation (CCT) and the Franco-German Parliamentary Assembly.     On 29 April, the President of the MOT, Christian Dupessey, was received by the French Minister for Territorial Cohesion and Relations with Local Governments, Jacqueline Gourault. It was an opportunity to address several key topics for the MOT: the “4D Bill” which will include, as confirmed by Ms Gourault, a cross-border component; the French Presidency of the EU during the first half of 2022; as well as the partnerships with the minister’s office, the ANCT and the DGCL (Directorate-General for Local Government).

    With the "Territoires en commun" (“Territories in Common”) platform launched on 19 January, the National Agency for Territorial Cohesion and the Banque des Territoires wish to enable all territorial authorities to have access to technical assistance for cooperation and citizens’ participation. The goal is to support territorial authorities and their partners – particularly state partners – in the appropriation of methods enabling the co-design of projects.

    Following on from the words of the Minister Jacqueline Gourault*, which give cross-border territories the role of “laboratories for the next stage of decentralisation”, serving as areas of experimentation at the forefront of territorial differentiation, the MOT wishes to elaborate with its network a joint position to incorporate the cross-border dimension into the 3D bill (Decentralisation, Differentiation and Deconcentration). This is due to be presented in the Council of Ministers in January 2021.

    What is a Cross-Border Cooperation Strategy?

    The Cross-Border Cooperation Strategy first appeared with the French MAPTAM Act of 2014, which affirmed the role of metropolises. It is a strategic coordination document for the French side of the border aimed at enabling cross-border actions. The act provides for its drafting by metropolises that border on a foreign country, in association with "the department, the region and the municipalities concerned".

    A new decree concerning the right of derogation available to prefects was adopted on 8 April 2020, in France. In accordance with the commitment made by the French President, and following an experiment conducted over nearly two years, it was decided to extend the power of derogation to all prefects and thereby step up the devolving of decisions to the local level.
