At the invitation of the Moselle department and the Metz Eurometropolis, both members of the MOT network, the MOT's annual event brought together almost 150 participants from all across France over the course of two days, on the 27th and 28th of June.
At the conference "Border Region Academy: Border regions of Germany with its neighboring countries" organized by the German Federal Office for Spatial Planning on April 20th and 21st in Berlin, in which the MOT participated, several significant studies for cross-border cooperation were presented.
On March 8th, 2023, the French Minister of Labor, Full Employment and Integration, Olivier Dussopt, presented to the Council of Ministers the draft law establishing a legal framework for cross-border apprenticeships.
The 3DS bill (standing for differentiation, decentralisation, deconcentration and simplification of local public action) was adopted in its final reading at the Assemblée Nationale and the Senate in France on 8-9 February. The MOT is delighted about the inclusion for the first time of a chapter devoted to cross-border cooperation in a piece of legislation.
The MOT took part in this conference organised within the framework of the French Partnership for Cities and Territories. It led one of its four workshops, on cross-border and European cooperation initiatives, and was able to get across the following message: sustainable development also needs to cross borders and requires cross-border cooperation.
From 1 January until 30 June 2022, France holds the presidency of the European Union Council, for the 13th time. At a press conference on 9 December, President Emmanuel Macron set out the presidency’s three main themes: "recovery", "power" and "belonging". On this last point, he emphasised that the feeling of belonging to the European region had "declined" in France, as in other EU countries.
Following its adoption at its first reading in the Senate on 21 July 2021, the 3DS bill (standing for “differentiation, decentralisation, deconcentration and various measures to simplify local public action”) will be examined under a fast-track procedure in the Assemblée Nationale, in France, from the beginning of December. Taking on a number of the proposals put forward by the MOT, the senators adopted a series of amendments relating to cross-border issues.
In order to involve the greatest number of citizens in the Conference on the Future of Europe, the Committee of the Regions (CoR) has initiated the setting-up of a “European network of regional and local councillors for the EU”.
In anticipation of the reading of the 4D bill in Parliament, the MOT, on behalf of its network, has sent to the co-rapporteurs of the Senate’s Law Commission on this legislation proposed amendments aimed at strengthening its cross-border component.
The “4D” bill was presented during the Council of Ministers’ session on 12 May. It will be subject to an accelerated parliamentary procedure, and its reading in the Senate is scheduled for July.
Since 2018, the advances in Franco-German relations are major: the signing of the Aachen Treaty, the creation of the Franco-German Committee on Cross-border Cooperation (CCT) and the Franco-German Parliamentary Assembly. These democratic innovations, a first in Europe, are enabling us to identify territorial dissonances and to take action to harmonise our national legal frameworks.
On 29 April, the President of the MOT, Christian Dupessey, was received by the French Minister for Territorial Cohesion and Relations with Local Governments, Jacqueline Gourault. It was an opportunity to address several key topics for the MOT: the “4D Bill” which will include, as confirmed by Ms Gourault, a cross-border component; the French Presidency of the EU during the first half of 2022; as well as the partnerships with the minister’s office, the ANCT and the DGCL (Directorate-General for Local Government).
On 16 March 2021, French Parliament definitively adopted the draft legislation aimed at simplifying and developing local experimentation initiated by territorial authorities.
In 2020, the French government put the so-called 4D Bill – on decentralisation, deconcentration, differentiation and decomplexification – on the political agenda. This is good news for cross-border territories.
With the "Territoires en commun" (“Territories in Common”) platform launched on 19 January, the National Agency for Territorial Cohesion and the Banque des Territoires wish to enable all territorial authorities to have access to technical assistance for cooperation and citizens’ participation. The goal is to support territorial authorities and their partners – particularly state partners – in the appropriation of methods enabling the co-design of projects.
Having for centuries been areas of expectations, fears and conflict, European borders are now the subject of a Forum. It is a fine symbol. In these difficult times, solutions can only come from our ability to make cross-border areas places of convergence, trust and partnership.
Following on from the words of the Minister Jacqueline Gourault*, which give cross-border territories the role of “laboratories for the next stage of decentralisation”, serving as areas of experimentation at the forefront of territorial differentiation, the MOT wishes to elaborate with its network a joint position to incorporate the cross-border dimension into the 3D bill (Decentralisation, Differentiation and Deconcentration). This is due to be presented in the Council of Ministers in January 2021.

The Cross-Border Cooperation Strategy first appeared with the French MAPTAM Act of 2014, which affirmed the role of metropolises. It is a strategic coordination document for the French side of the border aimed at enabling cross-border actions. The act provides for its drafting by metropolises that border on a foreign country, in association with "the department, the region and the municipalities concerned".
A new decree concerning the right of derogation available to prefects was adopted on 8 April 2020, in France. In accordance with the commitment made by the French President, and following an experiment conducted over nearly two years, it was decided to extend the power of derogation to all prefects and thereby step up the devolving of decisions to the local level.
The Act (No. 2019-816) of 2 August 2019 concerning the competences of the European Territorial Authority of Alsace (CEA) ratified the creation of this new territorial authority arising from the merger of the French Bas-Rhin and Haut-Rhin Departments on 1 January 2021.
The French decree establishing the European Territorial Authority of Alsace through the merger of the Bas-Rhin and Haut-Rhin Departments was published on 28 February. The new authority will come into being on 1 February 2021.

Created by the common desire of the presidents of eight Public Entities of Intermunicipal Cooperation, the new “North Lorraine Border Region Metropolitan Pole” was launched on 9 January 2019 in Thionville.
The Assembly of French Departments (ADF) has published an atlas of departments’ European and international cooperation actions. It notably details the collaborations pertaining to cross-border cooperation. The publication was realised in partnership with the Delegation for External Action of Territorial Authorities of the French Ministry for Europe and International Affairs, and the Banque des Territoires.
